Thread: Granfather clauses

Hola a todos: traduciendo un texto sobre requisitos para redactar documentos de una empresa, me topé con el curioso término "grandfather clause", que hace referencia a reglamentaciones antiguas que se siguen aplicando en algunos casos, aunque exista una nueva reglamentación que se utilice en la gran mayoría de las situaciones. ¿Cuál les parece la mejor traducción? "Cláusula del abuelo" se utiliza, pero creo que es un tanto calcada y no suena muy seria. ¿Qué les parece?

Hola, estuve buscando un poco al respecto y sí, se utiliza "Cláusula del abuelo", aunque claro, como decís no suena muy bien, se me ocurre algo así como "Cláusula no retroactiva" pero eso aplicaría a la nueva cláusula y no a la antigua. "Cláusula previamente vigente" suena más serio pero no es tan preciso creo.

Sí, es la opción más utilizada. También encontré "cláusulas de derechos adquiridos", pero no estoy segura de que signifique lo mismo

If you are looking for the significance of what a ¨Grandfather Clause¨ is, such an inclusion in a legal or business document can have one of two, contradictory meanings. Depending on how written into the document it can mean that either A) The effects of the document apply to conditions and, or ¨things¨ that were present prior to the signing and, or effective date of the document, or, B) That it does NOT apply to anything prior to the signing and, or effective date of the document.

A simple example of grandfathering, as it is called, is if an airline were to raise its fares AFTER you purchase your ticket. You go to the airport to check in and they tell you that you owe them $25 because fares increased after you bought your ticket. That would be ¨grandfathering¨ the fare increase. If the fare increase is not applicable to tickets already purchased prior to the effective date of the increase, it is ¨not grandfathered¨.
