    Default Confusion /confisión

    Dear colleagues: I wonder iF there is a term in English for the Spanish term “confusión” , within the context of a debt settlement trough merger; i.e. two entities which hold accounts receivables with each other, and said accounts get “confused” due to a merger between these two entities. In Spanish (and under this context) “confusión” is categorized as a way to settle debts.

    Hola exx !!!
    El término legal es “confusión” y es una forma de extinción de deuda. Normalmente ocurre cuando una sociedad acreedora y una sociedad deudora se fusionan y al quedar una sociedad resultante (la cual es deudora y acreedora de la mencionada deuda) se extingue la deuda por confusión. Intento averiguar si en inglés hay un término jurídico equivalente

    Hi Hebe! The Diccionario de Ciencias Jurísdicas y Políticas de Ossorio says:

    Confusión de derechos
    Es una de las formas típicas de extinción de las
    obligaciones. Tiene lugar cuando se reúnen en
    una misma persona, por sucesión universal o
    cualquier otra causa, la calidad de acreedor y la
    de deudor, así como también cuando una tercera
    persona sea heredera del acreedor y del deudor.
    Puede ser total o parcial.

    The Bilingual Legal Dictionary (Bossini & Gleeson) says extinguishment of rights due to the merging of debtor and creditor in the same person.
