Did you get an answer to this question? Excepción previa = demurrer; motion to dismiss (according to Orellana), and especial pronunciamiento, could be "special ruling" I am not sure. If you got an answer, I would be interested in knowing the correct answer.

Es parcialmente cierto, toda vez que si bien es cierto, los artículos de previo y especial pronunciamiento son dilatorios, también lo es que pudiera surgir una cuestión perentoria dentro del asunto, y estarías inventando un concepto legal.
Pero no la resuelves en un incidente de previo y especial pronunciamiento
